1. General Provisions
This personal data processing policy has been drafted in accordance with the requirements of Federal Law No. 152-FZ of July 27, 2006 "On Personal Data" (hereinafter, the Personal Data Law) and defines the procedure for personal data processing and the measures taken to ensure the security of personal data by BRICS LLC (TIN 1685022491 PSRN 1251600035290) (hereinafter, the Operator).
1.1. The Operator's foremost purpose and condition for carrying out its activities is to observe the rights and freedoms of humans and citizens when processing their personal data, including the protection of rights to privacy, personal and family secrets.
1.2. This Operator's Policy regarding the personal data processing (hereinafter, the Policy) applies to all information that the Operator may obtain about visitors to the website https://miss-brics.ru (including the subdomain https://shop.miss-brics.ru).
2. Key Definitions Used in the Policy
2.1. Automated processing of personal data — is personal data processing using computer technology.
2.2. Personal data blocking— is the temporary cessation of processing of personal data (except in cases where processing is necessary to clarify personal data).
2.3. Website — is a collection of graphic and informational materials, as well as computer programs and databases, ensuring their availability on the Internet at the network address https://miss-brics.ru (including the subdomain https://shop.miss-brics.ru).
2.4. Personal data information system — is a collection of personal data contained in databases, and the information technologies and technical means that ensure their processing.
2.5. Personal data depersonalization — are actions as a result of which it becomes impossible to determine personal data affiliation to a specific User or other subject of personal data without using additional information.
2.6. Processing of personal data — is any action (operation) or a set of actions (operations) performed with or without automation tools use with personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, and destruction.
2.7. Operator — a state body, municipal body, legal entity or individual, independently or jointly with other persons, organizing and/or carrying out the personal data processing, as well as determining the purposes of it, its composition, and the actions (operations) performed with personal data.
2.8. Personal data — any information relating directly or indirectly to a specific or identifiable User of the website https://miss-brics.ru, (including subdomain https://shop.miss-brics.ru).
2.9. Personal data permitted for dissemination by the personal data subject — is personal data to which unlimited access has been granted by the personal data subject by giving consent to the processing of personal data permitted for dissemination, in the manner prescribed by the Personal Data Law (hereinafter, personal data permitted for dissemination).
2.10. User – is any visitor of the website https://miss-brics.ru, (including subdomain https://shop.miss-brics.ru).
2.11. Provision of personal data — is action aimed at personal data disclosure to a specific person or a specific range of people.
2.12. Personal data dissemination — is any action aimed at personal data disclosure to an indefinite range of people (personal data transfer) or at making personal data known to an unlimited range of people, including personal data publication in the media, placement in information and telecommunication networks, or providing access to personal data in any other way.
2.13. Personal data destruction — is any action as a result of which personal data is irretrievably destroyed with the impossibility of further content restoration in the personal data information system and/or the material carriers of personal data are destroyed.
3. Basic Rights and Obligations of the Operator
3.1. The Operator has the right to:
- receive accurate information and/or documents containing personal data from the personal data subject;
- continue processing personal data without the personal data subject consent if there are grounds specified in the Personal Data Law in the event the personal data subject withdraws consent to the processing of personal data;
- determine solely the composition and list of measures necessary and sufficient for ensuring compliance with the obligations provided for by the Personal Data Law and regulatory legal acts adopted in accordance with it, unless otherwise provided by the Personal Data Law or other federal laws.
3.2. The Operator is obliged to:
- provide the personal data subject upon their request, with information concerning their personal data processing;
- organize the personal data processing in the manner established by the current Russian Federation legislation;
- respond to appeals and requests from personal data subjects and their legal representatives in accordance with the requirements of the Personal Data Law;
- report to the authorized body for personal data subjects rights protection, upon request from this body, the necessary information within 30 days from the date of receipt of such request;
- publish or otherwise provide unrestricted access to this Policy regarding the processing of personal data;
- take legal, organizational, and technical measures to protect personal data from unlawful or accidental access, destruction, alteration, blocking, copying, provision, dissemination of personal data, as well as from other unlawful actions in relation to personal data;
- cease the transfer (dissemination, provision, access) of personal data, stop processing, and destroy personal data in the manner and in the cases provided for by the Personal Data Law;
- fulfill other duties provided for by the Personal Data Law.
4. Basic Rights and Obligations of Personal Data Subjects
- receive information regarding their personal data processing, except in cases provided for by federal laws. The information is provided to the personal data subject by the Operator in an accessible form, and it must not contain personal data relating to other personal data subjects, unless there are legal grounds for disclosing such personal data. The list of information and the procedure for obtaining it are established by the Personal Data Law;
- demand from the Operator the clarification of their personal data, their blocking, or destruction in case when the personal data is incomplete, outdated, inaccurate, unlawfully obtained, or not necessary for the stated purpose of processing, as well as take measures provided by law to protect their rights;
- impose a condition of prior consent when processing personal data for the purpose of promoting goods, works, and services on the market;
- withdraw consent to personal data processing;
- appeal to the authorized body for the personal data subjects rights protection or in court against unlawful actions or inaction of the Operator in the processing of their personal data;
- exercise other rights provided for by the legislation of the Russian Federation.
4.2. Personal data subjects are obliged to:
- provide the Operator with accurate personal data;
- inform the Operator of any clarification (update, change) of personal data.
4.3. Users who have transferred inaccurate information, or information about another personal data subject without the latter's consent to the Operator shall be held liable in accordance with the legislation of the Russian Federation.
5. Data
5.1. The Operator may process the following personal data of the User:
- Last name, first name, patronymic.
- E-mail address.
- Phone numbers.
- Address of actual residence and registration at the place of residence and/or place of stay.
5.2. Also, the site collects and processes anonymized data about visitors (including "cookie" files) using the Yandex Metrica internet statistics service.
5.3. The data listed above are hereinafter referred to in the text of the Policy by the general term Personal Data.
5.4. The Operator does not process special categories of personal data concerning racial or national origin, political opinions, religious or philosophical beliefs, or private life.
5.5. Personal data processing permitted for dissemination, which falls under the special categories of personal data specified in Part 1 of Article 10 of the Personal Data Law, is permitted in case the prohibitions and conditions provided for in Article 10.1 of the Personal Data Law are observed.
5.6. The User's consent to the personal data processing permitted for dissemination is formalized separately from other consents for personal data processing. In this case, the conditions provided, in particular, by Article 10.1 of the Personal Data Law are observed. The authorized body for the protection of the rights of personal data subjects establishes requirements for the consent content.
5.6.1 The User provides consent for personal data processing permitted for dissemination directly to the Operator.
5.6.2 The Operator is obliged, within a period not exceeding three business days from the moment of receiving the said User's consent, to publish information about the processing conditions, and about the existence of prohibitions and conditions existence on the personal data processing permitted for dissemination by an unlimited circle of persons.
5.6.3 The transfer (dissemination, provision, access) of personal data permitted for dissemination by the personal data subject must be stopped at any time upon the demand of the personal data subject. This demand must include the last name, first name, patronymic (if any), contact information (phone number, e-mail address, or postal address) of the personal data subject, as well as a list of personal data whose processing is to be stopped. The Operator to whom it was provided may only process the personal data specified in this demand.
5.6.4 The consent to personal data processing permitted for dissemination terminates from the moment the Operator receives the demand specified in clause 5.6.3 of this Policy regarding the processing of personal data.
6. Principles of personal data processing
6.1. Personal data processing is carried out on a lawful and fair basis.
6.2. Personal data processing is limited to achieving specific, predetermined, and lawful purposes. Processing of personal data that is incompatible with the purposes of collecting personal data is not permitted.
6.3. It is not permitted to combine databases containing personal data, the processing of which is carried out for purposes incompatible with each other, is not permitted.
6.4. Only personal data that meets the purposes of its processing is subject for processing.
6.5. The content and volume of the processed personal data correspond to the stated purposes of processing. The processed personal data must not be excessive in relation to the stated purposes of their processing.
6.6. Personal data accuracy, its sufficiency, and, where necessary, relevance to the purposes of processing the personal data is ensured during data processing. The Operator takes necessary measures and/or ensures their adoption to delete or clarify incomplete or inaccurate data.
6.7. Personal data is stored in a form that allows the personal data subject identification for no longer than period that required by the purposes of personal data processing, unless the storage period for the personal data is established by federal law, a contract to which the personal data subject is a party, beneficiary, or guarantor. The processed personal data is destroyed or depersonalized after the processing purposes achievement or in the event of the loss of the need to achieve these purposes, unless otherwise provided by federal law.
7. Purposes of Processing Personal Data
7.1. The purpose of processing the User's personal data:
- informing the User by sending e-mails;
- conclusion, execution, and termination of civil law contracts;
- providing the User with access to the services, information, and/or materials contained on the website https://miss-brics.ru (including the subdomain https://shop.miss-brics.ru).
7.2. Likewise, the Operator has the right to send the User notifications about new products and services, special offers, and various events. The User may always opt out of receiving informational messages by e-mailing the Operator at the address org@miss-brics.ru with the topic "Opt out of notifications about new products and services and special offers."
7.3. Anonymized User data collected using internet statistics services is used to gather information about User actions on the site, and to improve the quality of the site and its content.
8. Legal Grounds for Processing Personal Data
8.1. The legal grounds for processing personal data by the Operator constitute of:
- listing of the regulatory legal acts governing relations related to your activity. For example, if your activity is related to information technologies, in particular the creation of websites, then here you may specify Federal Law No. 149-FZ of July 27, 2006 "On Information, Information Technologies and Information Protection"; Federal Law No. 152-FZ of July 27, 2006 "On Personal Data"; Federal Law No. 2300-1 of February 7, 1992 "On Protection of Consumer Rights" (for processing customer data); the Civil Code of the Russian Federation (for processing for the purpose of contract execution); the Tax Code of the Russian Federation (for data storage).
- the constituent documents of the Operator;
- contracts concluded between the Operator and the personal data subject;
- federal laws and other regulatory legal acts in the field of personal data protection;
- user consent to personal data processing, and for personal data permitted for dissemination.
8.2. The Operator processes the User's personal data only if is filled in and/or sent by the User independently through special forms located on the website https://miss-brics.ru (including the subdomain https://shop.miss-brics.ru) or sent by the Operator via e-mail. By filling out the relevant forms and/or sending their personal data to the Operator, the User expresses their consent to this Policy.
8.3. The Operator processes anonymized data about the User if this is permitted in the User's browser settings (saving of "cookie" files and the use of JavaScript technology are enabled).
8.4. The personal data subject independently makes the decision to provide their personal data and gives consent freely, by their own will, and in their own interest.
9. Conditions for Processing Personal Data
9.1. Personal data processing is carried out with the personal data subject consent to its processing.
9.2. Personal data processing is necessary to achieve the purposes provided for by an international treaty of the Russian Federation or by law, to carry out the functions, powers, and duties assigned to the operator by the legislation of the Russian Federation.
9.3. Personal data processing is necessary for the administration of justice, the execution of a judicial act, an act of another body or official, subject to execution in accordance with the legislation of the Russian Federation on enforcement proceedings.
9.4. Personal data processing is required for the performance of a contract to which the personal data subject is a party or beneficiary or guarantor, as well as for the conclusion of a contract at the initiative of the personal data subject or a contract under which the personal data subject will be a beneficiary or guarantor.
9.5. The processing of personal data is necessary for the exercise of the rights and legitimate interests of the operator or third parties, or for achieving socially significant goals, provided that the rights and freedoms of the personal data subject are not violated.
9.6. The processing of personal data is carried out, access to which is granted to an unlimited range of persons by the personal data subject or at their request (hereinafter, publicly available personal data).
9.7. The processing of personal data subject to publication or mandatory disclosure in accordance with federal law is carried out.
10. Procedure for the Collection, Storage, Transfer, and Other Types of Processing of Personal Data.
The security of personal data processed by the Operator is ensured by implementing legal, organizational, and technical measures necessary to fully comply with the requirements of the current legislation in the field of personal data protection.
10.1. The Operator ensures the safety of personal data and takes all possible measures to exclude access to personal data by unauthorized persons.
10.2. The User's personal data will never, under any circumstances, be transferred to third parties, except in cases related to the implementation of current legislation, or if the personal data subject has given consent to the Operator to transfer data to a third party for the performance of obligations under a civil law contract.
10.3. If inaccuracies in the personal data is identified, the User may update them independently by sending a notification to the Operator at the Operator's email address org@miss-brics.ru with the note "Updating personal data."
10.4. The period for processing personal data is determined by the achievement of the purposes for which the personal data was collected, unless a different period is provided for by the contract or current legislation, but for no less than 5 years from the date of the last activity. The User may at any time withdraw the consent to the processing of personal data by sending a notification to the Operator via email to the Operator's email address org@miss-brics.ru with the note "Withdrawal of consent to the processing of personal data."
10.5. All information collected by third-party services, including payment systems, communication tools, and other service providers, is stored and processed by these services (third parties) in accordance with their User Agreement and Privacy Policy. The personal data subject and/or the User is obliged to independently and promptly familiarize themselves with these documents. The Operator is not responsible for the actions of third parties, including the service providers specified in this clause.
10.6. Prohibitions, established by the personal data subject on the transfer (except for granting access), as well as on the processing or conditions of processing (except for obtaining access) of personal data permitted for dissemination, do not apply in cases of processing personal data in state, public, and other public interests defined by the legislation of the Russian Federation.
10.7. The Operator ensures the confidentiality of personal data when processing personal data.
10.8. The Operator stores personal data in a form that allows the identification of the personal data subject for no longer than is required by the purposes of processing the personal data, unless the storage period for the personal data is established by federal law, a contract to which the personal data subject is a party, beneficiary, or guarantor.
10.9. The conditions for terminating the processing of personal data may be the achievement of the purposes of processing the personal data, the expiration of the consent of the personal data subject, or the withdrawal of consent by the personal data subject, as well as the discovery of unlawful processing of personal data.
11. List of Actions Performed by the Operator with the Received Personal Data
11.1. The Operator performs the collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (dissemination, provision, access), depersonalization, blocking, deletion, and destruction of personal data.
11.2. The Operator performs an automated processing of personal data with or without the receipt and/or transmission of the obtained information via information and telecommunication networks.
12. Personal Data Confidentiality
The Operator and other person who have gained access to personal data are obliged not to disclose to third parties and not to distribute personal data without the personal data subject consent, unless otherwise provided by federal law.
13. Final Provisions
13.1. The User may obtain any clarifications on interest issues concerning the processing of their personal data by contacting the Operator via email at org@miss-brics.ru.
13.2. This document will reflect any changes to the Operator's personal data processing policy. The Policy is valid indefinitely until replaced by a new version.
